Terms & Conditions

By accessing or using Regalis Realty Media's services — including but not limited to real estate photography, videography, drone/aerial media, floor plans, 3D tours, listing websites, virtual/AI image enhancements, branding and agent content, CRM services, lead generation, and marketing automation (collectively, the "Services") — you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

Booking or requesting a shoot, scheduling Services, enrolling in any membership or program, and accessing, downloading, or submitting payment for any delivered media each independently constitute your acceptance of these Terms. If you book Services or accept media on behalf of a brokerage, team, or another agent, you represent that you are authorized to agree to these Terms on their behalf.

Regalis Realty Media is based in New York City and provides Services throughout New York City and New Jersey. Our Services include, without limitation: HDR listing photography; aerial/drone photography and video; listing, branding, and community video; 2D and 3D floor plans; Zillow 3D interactive tours and other third-party-hosted tours; virtual staging, virtual twilight, virtual renovation, object/clutter removal, and grass/lawn replacement; listing websites; agent branding and headshot sessions; recurring agent and community content; volume/membership programs; and performance-marketing, CRM automation, and lead-generation solutions.

All Services are provided "as is" and "as available" without warranties of any kind, express or implied.

• You agree to provide accurate and complete information necessary for the completion of Services, including accurate property square footage (see Section 05).
• You are responsible for complying with all applicable laws and regulations related to your use of our Services.
• You agree not to use our Services for any illegal, harmful, or unauthorized purpose.
• You acknowledge that Regalis Realty Media is not responsible for any outcomes related to the use of our marketing, lead-generation, or automation Services, including but not limited to sales conversions, lead quality, or engagement levels.
• Agent/Broker Responsibilities. Agents and brokers utilizing our Services to market a property or listing are responsible for ensuring the property is fully prepared, cleaned, and up to standard for shooting per the Listing Prep Checklist. Listings that are not fully prepared are subject to additional fees if additional servicing is required to achieve quality results. Regalis Realty Media reserves the right to charge additional fees for extra work needed due to inadequate preparation.

Regalis Realty Media prices most listing Services by home square footage, across defined size tiers, rather than by photo count. Photography includes complete, MLS-ready interior and exterior coverage scaled to the property — there are no photo caps and no per-photo fees. The number of final images varies with the size, layout, and features of the property; a typical home receives approximately 25–50 finished images. No fee is charged for delivering more or fewer images than a typical set.

Homes over 5,500 square feet, unusual layouts, and large or complex properties are quoted individually. Current tier prices are those published on the then-current Regalis Realty Media price sheet, which is incorporated by reference and may be updated from time to time.

New Jersey & the boroughs and Manhattan are priced as distinct markets; the applicable market is determined by the property's location.

Because price is determined by home size, accurate square footage is essential. The following governs how square footage is established and how discrepancies are handled.

(a) Client declaration. At booking, the client provides the property's square footage and selects (or is quoted) the corresponding size tier. The client represents that this figure is accurate to the best of their knowledge.

(b) Scan-measured square footage controls. For any booking that includes a floor-plan scan or 3D scan (2D floor plan, 3D floor plan, or Zillow 3D tour), the gross living area measured by that scan is the authoritative square footage and determines the applicable price tier — regardless of the figure declared at booking. If the measured size falls within a higher tier than the one booked, the price is adjusted up to the correct tier.

(c) Photo-only bookings (no scan). Where no scan is performed, Regalis Realty Media may verify the property's square footage against public records (county tax/assessor records, MLS data) and on-site observation. The applicable tier is set by the greater of the declared figure or the verified figure.

(d) Correction to the proper tier — no penalty. Where the correct square footage places the property in a higher tier than booked, Regalis Realty Media simply adjusts to the correct tier. No penalty or misdeclaration fee is charged — the client pays only the correct published rate for the property's actual size.

(e) Billing the difference. If the client has not yet paid, the corrected tier is reflected on the invoice before delivery. If the client has already paid at the lower (booked) tier, Regalis Realty Media will add the difference and re-send an updated invoice for the balance due.

(f) Unpaid balances carry to the next job. If a tier-difference balance is not paid, it remains due and will be automatically applied to and added onto the client's next booking or invoice. Consistent with Section 06, deliverables remain locked until the applicable invoice is paid in full, and outstanding balances accrue late-payment interest as provided in Section 16.

(g) Evidence. Any tier adjustment is based on the scan measurement and/or public records (county tax/assessor records, MLS data), not on on-site negotiation.

• All payments must be made upfront unless otherwise agreed in writing. Fees are non-refundable once work has commenced. If a project is canceled by the client after commencement, Regalis Realty Media reserves the right to retain payments made. Additional fees may apply for scope changes or revisions beyond the agreed scope.
• Delivery & Access (All Media). Upon completion, all media and deliverables — including photographs, video, drone/aerial media, floor plans, 3D tours, listing websites, and any other work product — are made available together with the final invoice. Previews may be provided in watermarked or low-resolution form for approval only. Until payment is received in full, the client may not view full-resolution files, access, download, license, or use any deliverable. Payment in full unlocks delivery and grants the agreed license.
• Cancellations, Reschedules & No-Shows. A scheduled shoot may be rescheduled or cancelled at no charge with at least twenty-four (24) hours' advance notice. Requests made less than 24 hours before the scheduled start time are subject to a $75 late-cancellation fee. If the crew arrives and the shoot cannot proceed — including no property access, no one available to provide entry, or a property occupied or unprepared to the point it cannot be shot (a "no-show or lockout") — a fee equal to the greater of $150 or fifty percent (50%) of the booked service total will apply, reflecting the lost appointment, travel, and crew time. Reschedules initiated by Regalis Realty Media (including for weather, equipment, or conditions outside the client's control) incur no fee.
• Aerial / Drone Weather & Conditions. Drone and aerial Services depend on safe and legal flying conditions and are subject to weather (wind, rain, low visibility), airspace restrictions, FAA regulations, and any required permits or advance booking (including, in New York City, additional municipal permitting). If conditions prevent or limit a flight, the aerial portion is rescheduled, not refunded, and the balance of the shoot proceeds as planned. Regalis Realty Media is not liable for delays, postponements, or turnaround impacts caused by weather, airspace, permitting, or FAA conditions.
• Conditions & Acceptance of Media. Media reflects the property and environmental conditions present at the time of the shoot — including weather, natural light, season, landscaping, cleanliness, staging, and overall presentation — all outside Regalis Realty Media's control. The client accepts the delivered media on this basis. Dissatisfaction with weather, property condition, staging, or presentation is not grounds for a refund, discount, or complimentary reshoot; reshoots requested for these reasons are booked as a new session at standard rates. Many such conditions can be addressed with optional enhancements (e.g., virtual twilight, sky replacement, object removal, grass replacement) for the applicable fee.

To ensure the highest-quality results, agents must adhere to the Listing Prep Checklist prior to the scheduled shoot. The delivered media reflects the property exactly as presented at the time of the shoot.

• Property Is Photographed As-Is. Regalis Realty Media captures the property as found and presented. The final product is a direct result of how the agent and homeowner prepared the listing. Regalis Realty Media does not stage, move, clean, or otherwise prepare the space.
• Failure to Meet Prep Standards. If the property is not prepped per the checklist, additional fees will be incurred to compensate for extra work required (e.g., moving furniture, clearing clutter), calculated based on additional on-site time.
• Photographer Is Not Responsible for Staging. The photographer's role is to capture the property, not to stage, move, or declutter. If the photographer must move objects, adjust decor, or prepare spaces that should have been prepped in advance, a preparation fee applies.
• Ineligibility for Reshoot. If a property is not adequately prepared, free reshoots will not be granted; a new session at standard rates is required.
• Object & Clutter Removal Is Not Included. Photographs are delivered as the property is presented at the time of the shoot. Object/clutter removal and grass/lawn replacement are available only as optional paid enhancements, billed at the rates on the current price sheet (see Section 08). Regalis Realty Media reserves the right to decline excessive, impractical, or unrealistic removal requests.

By booking a session, agents agree to these terms and accept responsibility for ensuring the property meets the preparation guidelines.

Optional post-production enhancements — including virtual staging, virtual twilight, virtual renovation, object/clutter removal, and grass/lawn replacement — are billed at the rates on the then-current price sheet (per photo, per block of photos, or per scene as specified there). Rush and same-day delivery options are available at the published rates. Bundle-and-save discounts on eligible enhancements apply as published. Enhancements depict simulated or altered conditions; where required by MLS, law, or platform policy, the client is responsible for appropriately labeling virtually staged, renovated, or otherwise digitally altered images.

Regalis Realty Media offers volume/membership programs (e.g., Team, Studio, Brokerage tiers) providing a locked flat per-listing rate and member benefits in exchange for a prepaid, committed listing volume per calendar quarter. The Volume Program is a prepaid commitment, not a pay-as-you-go arrangement.

• Prepaid commitment. Enrollment requires payment, in advance, for the tier's committed minimum number of listings for the quarter, at the locked per-listing rate. This prepayment reserves the member's rate, priority scheduling, and capacity for the quarter.
• Non-refundable. All Volume Program payments are non-refundable, in whole or in part, once the quarter has begun — including for any committed listings the member does not use.
• Use-it-or-lose-it; no rollover. Committed listings must be used within the calendar quarter for which they were purchased. Any unused listings expire at quarter-end. There is no rollover to a future quarter and no refund, credit, or transfer for unused listings; Regalis Realty Media retains the payment in full.
• What's included per listing. Each program listing includes the program's standard coverage — full interior & exterior HDR coverage, a 2D floor plan, a Zillow 3D interactive tour, and a listing website — for homes up to the published size ceiling (3,500 sq ft). Homes above the ceiling incur the published size surcharge ($100 per additional 1,000 sq ft), invoiced separately.
• Overage. Listings beyond the committed minimum within the same quarter are billed at the same locked member rate, subject to availability.
• Member benefits. Rate locked all quarter, priority scheduling, and member add-on rates apply as published. Member add-on rates do not stack with bundle discounts.
• Brokerage arrangements. Brokerage-level memberships may be governed by a separate written agreement, which controls in the event of any conflict with this Section.
• Non-transferable. Membership and its benefits are non-transferable except as expressly agreed in writing.

By enrolling, the member acknowledges and accepts responsibility for the committed volume and agrees that unused listings are forfeited at quarter-end with no refund or rollover.

• Standard Runtime. Listing, branding, and community videos are produced as short-form content with a standard maximum runtime of seventy-five (75) seconds, optimized for Reels, social media, and MLS delivery.
• Length Overage Fee. Where a client-provided script causes the finished video to exceed 75 seconds, a length-overage fee of $75 per additional 30 seconds (or any portion thereof) applies. When the script is submitted on time and the pre-production call is completed, this fee is quoted and approved before the shoot; otherwise it is assessed upon delivery and is final and non-negotiable.
• Script Submission Deadline. For any video requiring narration, voiceover, or on-camera dialogue, the client's final script must be submitted at least three (3) business days before the scheduled shoot.
• Mandatory Pre-Production Call. All scripted videos require a pre-production call to confirm runtime, wording, pronunciation, on-camera delivery, and any length overage. It is the client's responsibility to be available for this call.
• Late Scripts & Skipped Calls. If a script is submitted late, or the pre-production call is missed, the shoot proceeds as scheduled and: (i) the complimentary revision does not apply and all revisions become billable at $50 per revision round; and (ii) any length-overage, correction, or re-edit fees assessed upon delivery are final and non-negotiable — including corrections arising from the client's own script (misstated lines, factual/spelling errors, mispronunciations).
• Standard Revisions. For videos with a compliant, on-time script and completed pre-production call, one (1) revision round is included; additional rounds are $50 each. Re-shoots required due to client error are billed as a new session at standard rates.
• Script Accuracy & Claims. The client is solely responsible for the accuracy, completeness, and legality of all script content (representations about the property, schools, square footage, condition, pricing, and any other claims). Regalis Realty Media assumes no liability for statements in client-provided scripts.
• Extended Turnaround. Videos exceeding 75 seconds require additional production/editing time and are subject to extended turnaround scaled to length.
• Music & Song Selection. Regalis Realty Media provides licensed and royalty-free music. The client may select a song subject to availability and licensing, confirmed on the pre-production call; a later change is a billable revision. If the client asks Regalis to select the music, that selection is final and a later change is a billable revision. If the client requests a specific commercial or third-party song not covered by Regalis's licensing, the client does so entirely at their own risk and accepts full responsibility and liability — including any copyright claims, content-ID matches, takedowns, strikes, demonetization, removal, or legal action — and agrees to indemnify and hold Regalis Realty Media harmless from any resulting claims, damages, fees, or expenses.
• Client-Provided Assets. Any assets the client wishes to include (scripts, graphics, logos, branding files, voiceovers, music selections, photos, captions, or other materials) must be submitted at least three (3) business days before the shoot. Missing, incomplete, or late assets extend turnaround and any resulting revisions are billable.

Branding sessions, headshot days, agent content batches, community films/reels, and marketing/lead-generation programs (including the Agent Growth Engine) are governed by these Terms and by any program-specific scope, quote, or statement of work provided at booking. Where a program is "scoped on a call" or priced by quote, the agreed written scope and quote control. Marketing and lead-generation results are not guaranteed; Regalis Realty Media is not responsible for sales conversions, lead quality, engagement, or third-party platform performance (see Section 13).

All materials — including photographs, videos, floor plans, 3D tours, software, CRM tools, and marketing strategies developed by Regalis Realty Media — remain the sole intellectual property of the company unless explicitly transferred through written agreement. Upon payment in full, the client is granted the agreed license to use the delivered media to market the specific property or, for branding/content, the agent's brand. Unauthorized reproduction, resale, or redistribution is strictly prohibited.

• Regalis Realty Media provides Services "as is" without guarantees, warranties, or representations regarding results.
• We are not liable for any damages, including loss of profits, data, business opportunities, or reputational harm arising from your use of our Services.
• We are not liable for third-party actions, including platforms we integrate with (CRM providers, social media sites, advertising networks, etc.).
• Third-Party Platforms & Hosting. Certain deliverables — including Zillow 3D Home tours, Zillow interactive floor plans, and other media hosted, processed, or displayed on third-party platforms — rely on systems Regalis Realty Media does not own or control. Regalis is not responsible or liable for errors, processing mistakes, formatting changes, technical failures, outages, accessibility issues, or delays caused by these platforms (including Zillow, MLS systems, and hosting providers), nor for their turnaround times. Regalis's responsibility is limited to capturing and correctly submitting the media; the platform's handling, availability, and timing thereafter are outside our control.
• By using our Services, you agree to indemnify and hold Regalis Realty Media, its affiliates, employees, agents, and contractors harmless from any claims, liabilities, damages, or expenses arising from your use of our Services.

By using our Services, filling out a form, communicating with us, or opting into any offer, you agree to receive communications from us — including phone calls, text messages, emails, and direct messages — which may include service updates, promotions, follow-ups, and marketing materials. You may opt out of marketing messages at any time via the unsubscribe instructions provided. Regalis Realty Media complies with applicable privacy and communication laws and honors opt-in/opt-out procedures.

Regalis Realty Media reserves the right to refuse service, terminate contracts, or revoke access to our Services at any time without prior notice if the client violates these Terms.

• Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
• Arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Services shall be resolved through final and binding arbitration in the State of New York. Judgment on the award may be entered in any court of competent jurisdiction.
• Small Claims Exception. Either party may bring a qualifying claim in small claims court, provided it is within that court's jurisdictional limits and remains there (e.g., unpaid invoices).
• Prevailing Party & Collection Costs. In any dispute, arbitration, or collection action — including the pursuit of unpaid balances — the prevailing party is entitled to recover reasonable costs and attorneys' fees. A client whose nonpayment requires collection is responsible for Regalis Realty Media's reasonable costs of collection, including attorneys', arbitration, and court fees.
• Late Payments. Overdue balances accrue interest at one and one-half percent (1.5%) per month, or the maximum rate permitted by law if lower, until paid in full.

We reserve the right to modify these Terms at any time. Your continued use of our Services after modifications constitutes acceptance of the new Terms.
