Welcome to Regalis Realty Media. By accessing or using our services, you agree to comply with and be bound by the following Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. ACCEPTANCE OF TERMS

By accessing or using Regalis Realty Media’s services, including but not limited to real estate photography, videography, CRM services, lead generation, and automation (collectively, the "Services"), you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

2. SERVICES PROVIDED

Regalis Realty Media offers various services, including content creation, lead generation, CRM automation, and marketing solutions. All services are provided "as is" and "as available" without warranties of any kind, express or implied.

3. CLIENT RESPONSIBILITIES

a. You agree to provide accurate information necessary for the completion of services.

b. You are responsible for complying with all applicable laws and regulations related to your use of our Services.

c. You agree not to use our Services for any illegal, harmful, or unauthorized purposes.

d. You acknowledge that Regalis Realty Media is not responsible for any outcomes related to the use of our marketing, lead generation, or automation services, including but not limited to sales conversions, lead quality, or engagement levels.e. Agent/Broker Responsibilities: Agents and brokers utilizing our services for marketing a property or listing are responsible for ensuring that the property is fully prepared, cleaned, and up to standard for shooting preparations. Listings that are not fully prepared are subject to additional fees if additional servicing is required to achieve higher quality results. Regalis Realty Media reserves the right to charge additional fees for extra work needed due to inadequate preparation.

4. PAYMENT & REFUNDS

a. All payments must be made upfront unless otherwise agreed in writing.

b. Fees for Services are non-refundable once work has commenced.

c. If a project is canceled by the client after commencement, Regalis Realty Media reserves the right to retain any payments made.

d. Additional fees may apply for scope changes or additional revisions beyond the agreed-upon scope.

5. Listing Preparation & Additional Fees

To ensure the highest quality results, agents must adhere to the Listing Prep Checklist prior to the scheduled shoot. If a property is not properly prepared, the following conditions apply:

Failure to Meet Listing Prep Standards:

If the property is not prepped according to the checklist, additional fees will be incurred to compensate for extra work required to adjust the space (e.g., moving furniture, clearing clutter, etc.).These fees will be calculated based on the additional time spent on-site.

Photographer Is Not Responsible for Staging:

The photographer’s role is to capture the property, not to stage, move, or declutter items. If the photographer is required to move objects, adjust decor, or prepare spaces that should have been prepped in advance, a preparation fee will be applied.

Ineligibility for Reshoot:

If a property is not adequately prepared, reshoots will not be granted for free. Agents must book a new session at the standard rate if they wish to reshoot a listing that was not properly prepped.

Object Removal Policy

Object removal is included as part of the service; however, Regalis Realty Media reserves the right to determine what is considered excessive object removal.

If a property does not meet the Listing Prep Checklist standard and requires extensive object removal in post-production, additional fees may apply. Excessive object removal requests may be denied at the discretion of Regalis Realty Media.

By booking a session, agents agree to these terms and accept responsibility for ensuring the property meets the preparation guidelines.

6. INTELLECTUAL PROPERTY RIGHTS

All materials, including but not limited to photographs, videos, software, CRM tools, and marketing strategies developed by Regalis Realty Media, remain the sole intellectual property of the company unless explicitly transferred through written agreement. Unauthorized reproduction or redistribution is strictly prohibited.

7. DISCLAIMERS & LIMITATION OF LIABILITY

a. Regalis Realty Media provides services "as is" without any guarantees, warranties, or representations regarding results.

b. We are not liable for any damages, including but not limited to loss of profits, data, business opportunities, or reputational harm arising from your use of our Services.

c. Regalis Realty Media shall not be held liable for third-party actions, including but not limited to platforms we integrate with (CRM providers, social media sites, advertising networks, etc.).

d. By using our Services, you agree to indemnify and hold Regalis Realty Media, its affiliates, employees, agents, and contractors harmless from any claims, liabilities, damages, or expenses arising from your use of our Services.

8. OUTREACH METHODS & COMMUNICATION OPT-IN

a. By using Regalis Realty Media’s services, filling out a form, communicating with us, or opting into any of our offers, you agree to receive communications from us, including but not limited to phone calls, text messages, emails, and direct messages.

b. These communications may include service updates, promotions, follow-ups, and marketing materials.

c. Clients can opt out of marketing messages at any time by following the unsubscribe instructions provided in our communications.

d. Regalis Realty Media is legally compliant with all outreach communications and respects all applicable privacy laws regarding communication and opt-in/opt-out procedures.

9. TERMINATION

Regalis Realty Media reserves the right to refuse service, terminate contracts, or revoke access to our Services at any time without prior notice if the client violates these Terms.

10. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and interpreted in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in [Insert City/State].

11. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Your continued use of our Services after modifications constitute acceptance of the new Terms.
